“e-tons" mobile application - Management of construction material deliveries

PROCESSING OF YOUR PERSONAL DATA


We process your personal data in accordance with the principles set out in the regulations applicable to the protection of personal data, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and UK GDPR, and, where applicable, locally applicable law on personal data protection (hereinafter collectively referred to as the Personal Data Regulations).

VINCI Construction SI, located at 1973 boulevard de La Défense, 9200 Nanterre France (SIREN 414 965 053), the VINCI Construction organization that wishes to use it locally, its customers, and the company identified as a VINCI Construction organization’s customer or as your employer on your employment contract, process your data as independent data controllers for the management, via a mobile application installed on your smartphone, of the delivery of construction materials on behalf of VINCI Construction.

Unless expressly stated otherwise in this document, the legal basis for this processing by VINCI Construction is the legitimate interest (i) in centralizing logistical information, (ii) in avoiding the loss of logistical information, (iii) in facilitating the handling of any complaints or disputes and (iv) in taking measures appropriate cybersecurity for the mobile application.

This mobile application is intended for drivers external to VINCI Construction who work on behalf of VINCI Construction in the United Kingdom and the European Union to transport construction materials. Its purpose is to enable drivers to retrieve the electronic delivery note on their smartphone and manage their route (summary, event entry, and collection of the customer's electronic signature upon delivery).

Drivers affected by this mobile application will be informed by the local VINCI Construction entity that wishes to use it locally. Drivers who have been informed must use the mobile application and provide all of the data listed below; if a driver refuses to provide this data, the user account cannot be created and, as the case may be, the driver will not be able to make deliveries via the mobile application. The data or categories of data processed, the applicable retention periods and the recipients of the data are listed below, by purpose or objective of processing:

1) Access to a user account on the mobile application (account creation and authentication)

We implement technical and organizational measures to protect your data against unauthorized access, alteration, disclosure or destruction. Where credentials are used, you are responsible for keeping them confidential.

You have rights of access, rectification, erasure, restriction, objection, and to define instructions regarding your data after your death, in accordance with applicable regulations.

You may lodge a complaint with the competent supervisory authority if you believe your rights have not been respected.

Terms of Use – VAS Cloud Logistics Platform

These Terms of Use define the terms and conditions applicable to the use of the VAS Cloud Logistics Platform (the “Platform”). The Platform is a cloud-native SaaS solution, hosted by Axians IAS and published by VINCI Construction SI SNC (société en nom collectif) incorporated in France, with share capital of €28 626 735, registered with the Nanterre trade register under number 414 965 053, with its registered office at 1973, boulevard de la Défense – 92000 Nanterre, France (“Company” or “Publisher”).

The User has access through the Platform’s homepage to (a) the legal notices relating to the identification of the owner and host of the Platform and (b) Information notice regarding the use of personal data and cookie management.

1. Users

The users are authorized members of the central administration or of the staff of:

  • The Company’s affiliates, part of the VINCI Construction’s group, who use the Platform to manage the delivery process of their raw construction materials (the “Producer”),
  • The end customers to which the Producer’s raw construction materials are delivered by a Haulier (the “Customer”),
  • The hauliers in charge of the delivery by truck of raw construction materials from the Producer to the Customer (the “Haulier”),
  • Other service providers involved in all or part of the processing operations

who have received from the Company access to the Platform and who connect to the Platform for their professional needs in the scope of an eligible delivery.

2. Purpose of the Platform

The Platform is designed to facilitate between the Producers, the Customers and the Hauliers the logistics throughout the process of delivery by truck of raw construction materials. It enables Users to:

  • Create, edit and place delivery orders;
  • Track delivery status;
  • Manage delivery plannings;
  • Communicate relevant logistics information;
  • Store, view, download, and upload delivery documents;

3. Modules

The Platform contains various independent modules with specific functionalities. Main modules are:

  • Administration Portal Module for central data management and configuration
  • Customer Portal Module for creation and management of new orders
  • Order Planning Module for processing customer orders
  • Freight Portal Module for scheduling freight orders
  • Delivery Portal Module for creation and management of deliveries

4. Definable User Roles

According to their role in the delivery process each User is assigned by the Publisher a specific user role on the Platform such as “Buyer”, “Order Manager”, “Dispatcher/planner” or “Weigher” etc. and is granted specific access to some or all of the Modules and some or all of their functionalities.

5. Access and Authentication

Access to the Platform and to the Modules is restricted to authorized Users only. Each User must use their individual credentials (login and password) and is responsible for maintaining the confidentiality of their login information. Unauthorized access or use is strictly prohibited.

6. System Requirements

Users are responsible for ensuring that their devices meet the minimum technical requirements to access and use the Platform, including:

  • A stable internet connection;
  • A compatible web browser (e.g., Chrome, Firefox, Edge);
  • Updated antivirus and security software.

The Company is not responsible for any issues arising from incompatible or outdated systems.

7. Fees

The access to the Platform by the Users and the use of its functionalities is free of charge. The User may incur access or data fees from third parties in connection with the use of the Service (such as mobile phone operator fees, internet service provider fees). User is responsible for all such fees.

8. User Responsibilities

Users agree to:

  • Use the Platform solely for professional purposes in the scope of eligible raw construction material delivery process and in accordance with these Terms of Use;
  • Keep secure and confidential his login credentials, and refrain to share with any third party his login and password;
  • Ensure the accuracy and completeness of any data uploaded;
  • Refrain from any activity that may compromise the security or integrity of the Platform;
  • Refrain to interfere with the proper functioning of the site;
  • Immediately report any suspected breach or misuse.

User agree to indemnify and hold harmless the Company against any and all claims, demands, actions, losses, damages cost and expenses (including reasonable attorney fees) arising out of or relating to (a) the breach of these Terms of Use, (b) violation or non-compliance with any applicable law, rule or regulation, or (c) infringement, misappropriation or any violation of the rights of the Company or any other party.

9. Data Protection and Confidentiality

All data exchanged via the Platform is considered confidential. Users must comply with applicable data protection laws and internal company policies. Delivery documentation and associated data must not be shared with unauthorized third parties.

10. Data Retention

Delivery documentation and associated data uploaded to the Platform will be retained for a period consistent with legal and operational requirements. After this period, data may be archived or deleted in accordance with the Company’s data retention policy. Users are responsible for downloading and storing any documents they may need before deletion.

11. Proprietary Rights

The Platform, and all associated content, software, and intellectual property are the exclusive property of VINCI Construction SI or its licensors. All these elements are subject to the provisions of applicable French, German and international intellectual property regulations, and some of these elements may be protected by a copyright. They are therefore protected against any unauthorized use by law or by these Terms of Use.

Users are not permitted to copy, modify, distribute, decompile or reverse-engineer any part of the Platform or its components. Failure to comply with these provisions, particularly for commercial purposes, may result in legal action being taken on the grounds of infringement and/or unfair competition and/or parasitism by the holders of the rights in question. This is without prejudice to VINCI Construction SI's other rights, in particular the right to obtain compensation for any damage suffered.

12. Limited License

Users are granted a limited, simple, non-exclusive, non-transferable license to use the Platform and its functionalities solely for the purposes described in these Terms of Use and within the limits of his specific User role. No other rights or licenses are granted, explicitly or implicitly.

The right to use the Platform does not include the right to lease, lend, sublicense, distribute, publicly reproduce or otherwise make available to third parties the Platform or its software.

13. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damage arising from the use or inability to use the Platform, including but not limited to loss of profit, downtimes, financial loss, data loss or damage, system failures, or unauthorized access.

14. System Availability and Maintenance

The Company strives to ensure the Platform is available at all times. However, access may be interrupted for maintenance, force majeure or unforeseen technical issues. The Company is not liable for any disruption or data loss resulting from such interruptions.

15. Termination of Access

The Company reserves the right to suspend or terminate access to the Platform for any User who violates these Terms of Use or engages in unauthorized or harmful activity.

16. Acceptance of the Terms of Use

Accessing, viewing, browsing, and/or using the Platform and its functionalities constitute full and complete acceptance of these Terms of Use.

17. Modifications of the Terms of Use

These Terms of Use may be updated periodically. Users will be notified of significant changes and continued use of the Platform constitutes acceptance of the updated terms.

18. Validity of the Terms of Use

Each article of the Terms of Use applies separately. Any change to the applicable regulations in force, or any decision by a court or competent authority invalidating one or more articles of the Terms of Use, shall not affect the validity of the Terms of Use as a whole. Such a change or decision shall in no way authorize the User to disregard the valid provisions of the Terms of Use.

19. Applicable Law and Jurisdiction

These Terms of Use are governed by the substantive law of France. In the event of any dispute and after failure to find an amicable solution, jurisdiction is expressly granted to the Competent Court of Paris.
